Acceptance

These Terms of Use ("Terms") form a binding agreement between you and BetterStandingHub ("we," "us," "our") governing your use of betterstandinghub.com and related pages, forms, content and communications (the "Services"). By using the Services, you agree to these Terms and to our Privacy Notice. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old and a resident of the United States to use the Services. By using them, you represent that you meet these requirements and can enter into a binding contract.

Nature of the Services

BetterStandingHub provides free educational content about credit and a referral service that, at your request, shares your information with independent credit repair companies, credit counseling organizations and other financial services providers ("Partners").

  • BetterStandingHub does not itself provide credit repair services, does not contact credit bureaus or creditors for you, and does not charge you any fees.
  • We are not a lender, credit bureau, law firm or credit counseling agency.
  • We do not guarantee that any Partner will contact you, accept you as a client, or achieve any result.
  • Partners are independent businesses and are solely responsible for their services, fees, contracts and legal compliance.
  • We may receive compensation from Partners.

See our Credit Disclosures for more information, including your rights under the Credit Repair Organizations Act.

Educational content

Articles, examples, illustrations, score ranges and other content on the Services are general information only. They are not legal, financial, tax or credit advice and may not reflect your circumstances or current law. Example scores and timelines are hypothetical. Consult a qualified professional for advice specific to you.

Your information

You agree to provide accurate, complete and current information about yourself only. You may not submit information about another person without their permission or use a false identity. You authorize us to share your information with Partners and service providers as described in our Privacy Notice.

Communications

If you check the consent box on our form, you agree to be contacted as described on our Communication Consent page, which is part of these Terms. Consent is not required to purchase any product or service. You confirm that you are the subscriber or regular user of the phone number you provide. You agree that we may provide notices and records electronically and that your electronic consent is legally binding.

Acceptable use

You will not:

  • use the Services for any illegal, fraudulent or misleading purpose;
  • submit false information or information belonging to someone else;
  • use bots, scrapers or automated tools to access the Services or submit forms;
  • attempt to gain unauthorized access to, disrupt or damage the Services;
  • introduce malware or harmful code; or
  • copy, modify, distribute or commercially exploit our content without written permission.

Intellectual property

The Services and all content, including text, graphics, illustrations, logos and software, are owned by or licensed to BetterStandingHub and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. All other rights are reserved.

Third parties

We do not control and are not responsible for Partners or other third parties, including their services, advice, fees, websites or conduct. Any agreement you enter into with a Partner is solely between you and that Partner. Before signing up with a credit repair company, review its written contract and your three-day right to cancel.

Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that you will obtain any credit result, score change, approval or outcome.

Limitation of liability

To the fullest extent permitted by law, BetterStandingHub and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of or relating to the Services or any Partner's products or services. Our total liability for any claim will not exceed one hundred dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless BetterStandingHub and its owners, employees and contractors from claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your use of the Services, your submissions, or your violation of these Terms or of any law or third-party right.

Dispute resolution

Informal resolution

Before starting any proceeding, contact us at [email protected] with a description of your claim. We will both try in good faith to resolve it within 45 days.

Binding arbitration

If the dispute isn't resolved informally, you and BetterStandingHub agree that any claim arising from or relating to the Services, these Terms, or any communication from us or on our behalf, including claims under the Telephone Consumer Protection Act, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement. The arbitrator has exclusive authority to decide questions of arbitrability. Either party may bring a qualifying claim in small claims court instead.

Class action waiver

Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not consolidate claims or award class-wide relief.

Right to opt out

You may opt out of arbitration by sending written notice with your name, address, phone number and email and a statement that you opt out, to BetterStandingHub, 4100 E Harmony Ridge Rd, Suite 210, Phoenix, AZ 85018, or [email protected], within 30 days after your first use of the Services.

Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, and by the Federal Arbitration Act for arbitration. Claims not subject to arbitration must be brought in the state or federal courts located in Maricopa County, Arizona.

Changes

We may update these Terms by posting a revised version and changing the "Last updated" date. Your continued use of the Services after changes are posted means you accept them. Changes will not apply to disputes we already knew about.

General

These Terms, together with the policies they reference, are the entire agreement between you and us about the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may.
